1. Terms of use
- This web site is owned and operated by SalesMatch Ltd and is made available to you on the following terms and conditions. By using the site and the services available on it you are deemed to accept these terms and conditions and any additional terms and conditions which expressly apply to services and information provided by third parties.
2. Definitions
- "Candidate" means an individual (who may be referred to as a jobseeker) seeking to obtain employment using the websites.
- "Recruiter" means any individual, organisation or company using the services on the SalesMatch website for the purpose of identifying or contacting candidates.
- "Fee" means the fee payable by the recruiter to SalesMatch for the services as detailed on the website.
- "Recruitment Agency" means an Employment Agency or Employment Business as defined by the Employment Agencies Act 1973 (& all regulations made there under)
- "Services" means all recruitment products and services made available by us from time to time;
- "Websites" means Websites owned & managed by SalesMatch, as listed on www.salesmatch.co.uk
3. Use of the site
The information and services available on the site are provided for the sole purpose of individuals looking for employment opportunities and career information and for employers seeking to recruit staff. You may use, print and download information from the site for these purposes only and for no other personal or commercial purpose. You may not otherwise copy, display, transmit or distribute any material from the site.
All copyright, database rights and other intellectual property rights in the site and the material available on the site belong to SalesMatch or its third party suppliers. Use of the site does not give you any proprietary rights in such materials.
Employment Agencies and Employment Business Regulations 2003
Candidates and recruiters need to be aware that this website operates as a venue only and does not introduce or supply work-seekers to recruiters (or vice versa). This means that we do not:
- obtain sufficient information for potential recruiters to select a suitable candidate for the position which the recruiter seeks to fill;
- obtain confirmation of the identity of a candidate or that they have the experience, training, qualifications or authorisation to work in the position to be filled or that they wish to undertake the role to be filled;
- take any steps to ensure the candidate and recruiter are each aware of any requirement imposed by law or otherwise which must be satisfied by either of them to permit the candidate to fulfil the position to be filled;
- take any steps to ensure that it would not be detrimental to the interests of the candidate or the recruiter for the candidate to fulfil the position to be fulfilled;
- give any indication to recruiters whether candidates are unsuitable (or suitable) for any position to be filled in any circumstances;
- propose candidates to recruiters or provide any information about them.
- take up any references in relation to a candidate; or make any arrangements for accommodation of candidate.
The Conduct of Employment Agencies and Employment Business Regulations 2003 (the "Regulations") seek to ensure that candidates are only proposed by employment agencies for roles for which they are properly qualified and that recruiters are only offered candidates who have the appropriate levels of experience, training, qualifications and authorisation for the position to be filled. Since we are only a venue and do not propose or introduce candidates to recruiters or vice versa, it is recommended that, if you are a candidate you undertake the steps set out in the Regulations to ensure your suitability for the role advertised or, if you are a recruiter, to ensure a candidate’s suitability for the role.
4. Data Protection
- Contact and other details you supply about your company are stored by us and are used to provide you with the goods and services you have requested. They may also be used to provide SalesMatch Ltd’s users with a searchable directory for the purposes of looking for a job. The information supplied will not be used for any other purpose without your prior consent.

Curriculum vitae (CV) Opt Out:
We give you the option of submitting your CV via this website. You can do this either to apply for a specific advertised job or for consideration by our matching search engine and recruitment consultants for position as they come up. From time to time, we identify companies and organisations that have a recruitment requirement that we believe may be of interest to you. We may share your CV details, maintaining your anonymity with all personally-identifiable information removed. We will always gain your permission before disclosing Personally-Identifiable information to third parties that are not affiliated to SalesMatch Ltd.
5. Statistical Information
- We provide aggregate statistical information about site visitors and users to recruiters (such as the number of C.V.s on the database, or the number of visitors to the site) and for other lawful purposes. We provide this information to customers, advertisers, suppliers and other reputable third parties. This will not include any information that enables them to identify individual candidate.
6. Pricing
- Recruiters and Candidates shall pay SalesMatch for the services in full and shall pay all applicable VAT and other taxes imposed on charges for the service.
- If any Services to be used within any time period specified on the website are not used within that period of time they may not be carried over into any subsequent period without our prior written consent. The Recruiter and Candidate will be responsible for payment for any unused Services.
7. Recruiter Obligations & Responsibilities
The Recruiter accepts that, following any contact with Candidates:
- It shall be up to the Recruiter & the Candidate to agree how to progress matters further;
- That the Recruiter shall act in good faith & in a business like & courteous manner; &
- That the Recruiter shall keep strictly confidential all confidential information disclosed by the Candidate & act in accordance with the Data Protection Act 1998 & the Employment Agencies Act 1973 (& all other relevant legislation & regulations made there under).
- That the Candidate data purchased, remains the property of the Recruiter for a period of three months from the Fee payment date, or until the Recruiter has concluded the discussions with a Candidate in relation to a specific job search.
- The Recruiter agrees to abide by SalesMatch rules for job listings (which may vary from time to time), these rules are:
- Job information to be categorised accurately using the appropriate job category for each listing; &
- No gratuitous use of keywords in job descriptions, job summaries, job titles or keyword fields. Gratuitous is defined as inserting words, strings of words or repeating job titles which influence the position of the results listing; &
- Job information which discriminates on grounds of sex, race, age or disability is illegal & may result in proceedings being taken against the Recruiter.
- It is the Recruiter’s responsibility to advise SalesMatch of any change to their contact details, address &/or business activities.
- The Recruiter shall not resell the Service purchased or contracted from SalesMatch Ltd to any third party without authorisation in writing from a Director of SalesMatch.
- The Recruiter agrees that SalesMatch shall be entitled (in addition to its entitlement to terminate this Agreement) to remove any unauthorised listings as SalesMatch may in its sole discretion determine.
- The Service is for use by the Recruiter only & allows non-exclusive access to the Service using one unique pin & password in accordance with these Terms. If the Recruiter (including any of the Recruiter’s employees or consultants) is found to share passwords with any party who is not part of the Recruiter organisation or company then such sharing will be a material breach of this Agreement.
- The Recruiter shall ensure that no automatic extraction software (to include software tools commonly known as robots or spiders) or any other means are engaged or deployed to facilitate the downloading or capturing of C.V.s from the SalesMatch database irrespective as to which C.V. Service has been purchased from SalesMatch.
8. Candidate Obligations & Responsibilities
The Candidate accepts that:
- It shall conform to the SalesMatch anonymity policy and will ensure that all references to name, address, telephone numbers or email address are removed from C.V.s and any other supporting documentation before posting on the website.
- That the Candidate shall act in good faith & in a business like & courteous manner; &
- That the Candidate shall keep strictly confidential all confidential information disclosed by the Recruiter & act in accordance with the Data Protection Act 1998 & the Employment Agencies Act 1973 (& all other relevant legislation & regulations made there under).
- The Candidate agrees to abide by SalesMatch rules for information listings (which may vary from time to time), these rules are:
- Personal and Industry information to be categorised accurately using the appropriate category for each section; &
- No gratuitous use of keywords in C.V.s, career summaries, job titles or keyword fields. Gratuitous is defined as inserting words, strings of words or repeating job titles which influence the position of the results listing; &
- It is the Candidate’s responsibility to advise SalesMatch of any change to their contact details, address.
- The Candidate shall not resell or share the Service purchased or contracted from SalesMatch Ltd to any third party without authorisation in writing from a Director of SalesMatch.

9. SalesMatch Obligations & Responsibilities
- To provide the Services with reasonable care & skill.
- To maintain Services on a 24 hour by 7-day basis (subject to periodic essential maintenance).
- SalesMatch shall make such modifications to any Job information or other Service as are reasonably requested by the Recruiter provided that SalesMatch reserves the right to charge at its prevailing rates for the time involved with such modifications
- If SalesMatch receives complaints from any Candidate or otherwise becomes aware that a Candidate has been offered services, apart from specific live jobs, SalesMatch reserves the right to terminate or suspend the service without incurring liability to the Recruiter. The Recruiter will have no claim against SalesMatch in such circumstances. Furthermore, the Recruiter shall not be entitled to any refund of Fees paid to SalesMatch.
- SalesMatch may at its sole discretion add or remove any of the Website service without incurring liability to the Recruiter or Candidate.
- SalesMatch may at its sole discretion decide which job listing(s) are published to Websites & has the right to decline to publish or change job listings.
10. Termination
We may terminate the provision of Services if:
- The Recruiter or Candidate is in material breach of these terms and conditions and has not remedied such breach within ten days of notice specifying the breach and requiring that it be remedied, or:
- The Recruiter becomes insolvent, ceases to trade or goes into liquidation.
11. Security
The site is protected against unauthorised access using the latest security devices and 'firewalls'.
12. Governing Law
This Agreement shall be governed & construed in accordance with English law.
GENERAL
- No neglect, delay or indulgence by SalesMatch in enforcing any provision of this Agreement shall be construed as a waiver & no single or partial exercise of any right or remedy shall affect or restrict the further exercise or enforcement of any such right or remedy.
- A person who is not a party to this Agreement shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any of its Terms.
- The Agreement is personal to the Recruiter & may not be assigned or transferred to any third party without the prior written consent of a Director of SalesMatch.
- Each Term of this Agreement is severable & distinct from the others &, if any provision is, or at any time becomes to any extent or in any circumstances invalid, illegal or unenforceable for any reason, that provision shall to that extent be deemed not to form part of this Agreement but the validity, legality or enforceability of the remaining parts of this Agreement shall not be affected or impaired, it being our intention that every provision of this letter shall be & remain valid & enforceable to the fullest extent permitted by law.
- SalesMatch reserves the right to vary this Agreement from time to time. Such changes shall either be notified to you by e-mail or posted on www.salesmatch.co.uk . Such changes shall be deemed to be accepted if you continue to use the Websites or Service after a period of one week from the date of transmission of the e-mail or of posting on www.salesmatch.co.uk, whichever occurs later.
